Establishing Liability After a Dog Bite Accident 

Because California is a strict liability state, the information is pretty clear cut. According to the California Law, Section 3342, dog owners are liable for damages caused by their dog. This is true even if:


  • The dog attacked on the owner’s private property 
  • The dog never showed signs of aggression in the past

It covers any victim who was on the dog owner’s property, whether as a guest or in a professional setting (such as postal worker or repair person). However, you cannot claim personal injury if:


  • The dog was on duty from police or military work  
  • The dog was defending itself from harassment or attacks 
  • The dog did not bite but simply jumped and scratched

If a child is a victim of a dog bite accident, the parents may also make a personal injury claim.

If a dog was under the care of a child under age 5 at the time of the accident, the child cannot be sued for negligence.
